The Polish version is the original of this document. Other language versions are translations provided for convenience.
1. Preliminary Provisions
1.1. These Terms of Use (the “Terms”) set out the rules governing the use of the ARA Sign mobile application (the “Application”) and constitute a license agreement entered into between the user of the Application (the “User”) and the Publisher.
1.2. The Publisher of the Application is Krystian Janda Just In Time, ul. Lecha 5, 32-590 Libiąż, Poland, entered in the Polish Central Register and Information on Economic Activity (CEIDG), VAT ID (NIP) PL6281992900, business register number (REGON) 120722683 (hereinafter the “Publisher”).
Contact with the Publisher in all matters concerning the Application: email address office@jintsoftware.pl, telephone +48 737 496 462.
1.3. The license agreement is concluded when the User accepts the Terms in the Application. A User who does not accept the Terms does not acquire the right to use the Application.
1.4. The Terms are made available to the User before the agreement is concluded, within the Application, in a manner enabling the User to read, save and reproduce them. The current version of the Terms is available in the Application at all times.
1.5. For the purposes of these Terms, a “Consumer” means a natural person entering into a legal transaction with the Publisher that is not directly related to that person’s business or professional activity. The provisions concerning Consumers shall also apply, as appropriate, to a natural person entering into an agreement directly related to that person’s business activity where the content of that agreement indicates that it is not of a professional nature for that person.
1.6. The Terms do not constitute an assurance by the Publisher that any document created, modified, saved or shared using the Application is authentic, truthful, legally effective, signed by a particular person, accepted by a particular person, compliant with the law, or effective against any third party.
1.7. The Publisher is not a party to documents created or modified by the User using the Application, is not a party to agreements entered into by the User using such documents, and does not participate in the making by the User of declarations of intent or statements of knowledge contained in such documents.
2. Nature of the Application
2.0. The Application was created as a tool for the quick, local preparation of a PDF document by placing in it an image of the User’s own handwritten signature, initials or stamp — without the need to print the document, sign it on paper and scan it again. It is intended for persons who sign documents themselves, on their own behalf or on behalf of a business they operate, and who wish their documents to remain solely on their own device.
The Application is NOT intended for: placing in documents an image of another person’s signature without that person’s consent; preparing documents intended to create an impression of authenticity towards third parties contrary to the actual state of affairs; or replacing an electronic signature where the law or the other party requires a signature having a specific legal status.
2.1. The Application is a graphical tool operating locally on the User’s device. It enables the placement and editing of images, in particular images of handwritten signatures, initials and stamps, as well as text, date and locality, in documents in PDF format.
2.2. The Application is not a system for creating electronic signatures in the cryptographic sense. The Application does not generate a qualified electronic signature or a qualified electronic seal within the meaning of Regulation (EU) No 910/2014 of the European Parliament and of the Council (eIDAS), nor equivalent legal instruments provided for by other laws.
2.3. The Application is not a trust service for the creation, verification or validation of qualified electronic signatures or qualified electronic seals.
2.4. The Application does not provide mechanisms characteristic of an advanced electronic signature, in particular a mechanism ensuring the unambiguous linkage of the signature to the signatory, the possibility of establishing the signatory’s identity, the signatory’s sole control over the signature creation data, or the detection of subsequent changes to the data referred to in Article 26 of the eIDAS Regulation.
2.5. The Application does not connect to the Publisher’s servers for the purpose of identity verification, document certification or time synchronization. The date placed in a document can be freely edited by the User or is obtained from the clock of the User’s device and does not constitute a qualified electronic time stamp.
2.6. The Application does not verify the identity of the User or of any other person. The Application does not determine whether the person using the Application is the person whose signature, initials or stamp image has been placed in it, or whether that person is authorized to use such image.
3. Functions of the Application
3.1. The terms “signature”, “initials” and “stamp” used in the Application refer to elements placed by the User in a document: the image of the signature and of the initials, and the text of the stamp. The Application does not provide an electronic signing process involving identification or authentication of the signatory, cryptographic protection of the document, or mechanisms characteristic of advanced or qualified electronic signatures or qualified electronic seals. The mere use of the Application does not determine the legal effect of placing such an element in a particular document; its effectiveness, form and evidentiary value depend on the applicable law, the type of legal act and the circumstances in which it is performed.
3.2. The Application provides tools enabling the User to place in a document:
a) an image of a signature; b) an image of initials; c) a stamp; d) a stamp together with an image of a signature, as a single element; e) a locality; f) a date; g) text entered by the User.
3.3. The signature image and initials image are created on the basis of a photograph taken or selected by the User, in particular a photograph of a signature previously made on paper. The processing of this photograph by the Application is exclusively graphical in nature and consists of separating the ink trace from the background, straightening and cropping the image. The result is a new image file containing solely the extracted ink trace in the colour selected by the User.
3.4. A stamp is not created from a photograph. The User fills in text fields in the stamp editor, and the Application composes from them a block of text placed in the document. The fields include, in particular, the name of the entity, its continuation, first and last name, address and identification number, as well as additional lines. Fields may be left blank — empty fields are omitted. The content of the stamp is determined exclusively by the User. The Publisher does not verify the truthfulness or currency of the information entered or the User’s authorization to use such information.
3.5. The combined tool places a stamp together with an image of a signature in the document as a single element. This tool uses only the signature image; the initials image is not supported by this tool. That element consists of the image of the signature and of the text of the stamp.
3.6. The User enters the locality, date and text into a text field before placing them in the document. The date placed in the document can be freely edited by the User or is obtained from the device clock.
3.7. An element is placed by touching the selected location on the document page. Before confirming the placement, the User may change the position and size of the element. The placement, position and size of the element depend solely on the User’s decision. If the element does not fit on the page, the Application informs the User of this before confirmation.
3.8. The content and image of an element are saved when the element is confirmed. A subsequent change to a saved signature, initials or stamp data does not affect elements already placed in the document.
3.9. Saving the prepared document consists of creating a new PDF file containing the placed elements. The file designated by the User as the source file is not modified. The Application does not save metadata identifying the User, the device or the Publisher in the created file.
3.10. The User may save the prepared document to a location selected using the system save dialog and transfer it to another application using the system sharing function. Both operations concern the same prepared document. The choice of the storage location and recipient application rests solely with the User.
4. No Guarantee of the Legal Effect of a Document and Meaning of the Terms Used
4.1. The Publisher does not guarantee that a document prepared using the Application will produce the legal effect intended by the User.
4.2. The Publisher does not guarantee that the use of an image of a signature, initials or stamp in a particular document will satisfy the requirements concerning the form of a legal act, its validity, effectiveness or evidentiary value. This assessment depends on the type of legal act, the content of the document, the applicable law and the requirements of the entity to which the document is presented.
4.3. Before using a document prepared using the Application, the User is required to independently determine whether the form of that document is sufficient for the intended legal act and, in case of doubt, seek legal advice.
4.4. The Application does not constitute legal advice or a legal advisory service. The content provided in the Application is technical and informational in nature.
4.5. The terms “Signature”, “Sign document”, “New signature”, “Generate signature” and terms of similar meaning used in the Application, its interface and informational materials concerning the Application refer to a technical operation consisting of preparing or placing a graphical image in a document. Such terms do not mean that the Publisher:
a) confirms the identity of the person whose signature is represented by the image; b) confirms that such person actually made the signature; c) confirms that such person consented to the use of the image of their signature; d) confirms that such person has read the contents of the document; e) confirms that such person has accepted the contents of the document; f) certifies the document or confirms its authenticity; g) guarantees the legal effectiveness of the document.
4.6. The provisions of Section 4.5 clarify the meaning of the terms used in informational and marketing materials concerning the Application. Terms such as “sign with one tap”, “fast document signing” or similar terms describe the speed and manner of operating the graphical function of the Application, and not the legal properties of a document prepared using the Application.
4.7. Where materials concerning the Application use terms such as “your signature”, “own signature”, “real signature” or similar terms, they refer to the source handwritten signature presented by the User in the form of an image, and not to confirmation of identity, authenticity of a statement or its legal effectiveness.
4.8. The placement of an image of a signature, initials or stamp in a document does not, by itself, give rise to a presumption that the person presented as the signatory made the statement contained in the document, read its contents or accepted them.
4.9. The Publisher does not guarantee the authenticity of an image of a signature, initials or stamp, the authenticity of a document, or the truthfulness of the data contained therein.
5. User’s Responsibility
5.1. The User is required to use the Application in accordance with the law, the Terms and the principles of social coexistence.
5.2. The User is required to ensure that they have the right to use the image of a signature, initials, stamp, trademark and other content placed in a document, as well as the right to dispose of the document in which such content is placed.
The consent of another person to the use of the image of that person’s signature or initials is not sufficient in every case: under the established interpretation of criminal law provisions, placing another person’s signature or initials in a document in such a way that the document appears to have been signed by that person in person may constitute a criminal offence REGARDLESS of the fact that the person consented to it. Authority to act on behalf of another person is evidenced by a power of attorney and by the signature of the attorney, and not by reproducing another person’s signature or initials.
5.3. The User bears sole responsibility for the content of statements contained in documents prepared using the Application and for the consequences of using such documents.
5.4. The Application may be used solely for preparing documents in accordance with the law and solely to the extent to which the User is entitled to make use of the content being placed. The use of the Application is prohibited, in particular, for the purpose of:
a) placing in a document the image of another person’s signature, initials or stamp impression, whether alone or together with a stamp, in a manner creating the impression that the person signed the document in person; b) obtaining the image of another person’s signature, initials or stamp impression — from a document, photograph, scan, copy, device screen or any other source — in order to use it in the manner described in point a; c) using the image of a signature or initials made available by another person for a specific document — in a different document or beyond the scope of the authorisation granted; d) entering into the stamp data identifying another person or another person’s business, in particular a name, first name and surname, address or identification number, without authorisation to act on their behalf; e) placing in a document any content, including text, a date or a place name, after the document has been signed by another person, without that person’s knowledge and consent; f) preparing or modifying documents in order to mislead as to their authenticity, origin, content or date of preparation, including antedating documents; g) impersonating another person or a business; h) committing any other prohibited act.
5.5. The User is required to secure the device on which the Application is used in a manner preventing access by unauthorized persons, in particular by using a screen lock and installing operating system security updates. If the Application provides a local security code feature, the Publisher recommends using it. However, the Publisher does not guarantee that this mechanism will prevent every form of unauthorized access to the device or to data stored locally on it.
5.6. The User is responsible for the consequences of making the device or the Application available to a third party.
5.7. A breach of the prohibitions set out in clause 5.4 may constitute a criminal offence, in particular the offence of forging or altering a document or of using such a document as authentic (Article 270 of the Polish Criminal Code), of completing a form or other document bearing another person’s signature or initials contrary to the will of the signatory, or of using such a document (Article 270 § 2 of the Polish Criminal Code), of fraud (Article 286 of the Polish Criminal Code), of obtaining credit or a loan on the basis of an unreliable document (Article 297 of the Polish Criminal Code), of impersonating another person by using that person’s data (Article 190a § 2 of the Polish Criminal Code), or of processing personal data without a legal basis (Article 107 of the Polish Personal Data Protection Act), and may also give rise to civil liability towards injured persons.
Such liability is borne by the person committing the breach, on the terms laid down by law. This clause is informative in nature and does not modify the scope of that liability. The provisions of Polish law referred to above are given by way of example; in other jurisdictions the provisions applicable at the place where the act was committed shall apply.
6. Independent Actions of Third Parties
6.1. The Application is a local technical tool operating on the User’s device. The Publisher does not control the manner in which the User or a third party uses the Application after it has been installed, nor the source from which images and data entered into the Application originate.
6.2. The Publisher is not responsible for the acquisition by the User or a third party of an image of a signature, initials, stamp or other marking from a source independent of the Publisher, in particular from a paper document, photograph, scan, copy of a document, device screen, electronic message, website, other electronic document, or another device or software. This also applies where a third party obtains an image of a signature by taking a photograph or scan of it without the knowledge or consent of the person whose signature is represented by that image.
6.3. The Publisher is not responsible for the consequences of actions by the User or a third party consisting of the unlawful use of an image of a signature, initials, stamp or other marking, in particular for:
a) impersonating another person; b) making statements on behalf of another person without appropriate authority; c) creating or modifying a document for the purpose of presenting it as authentic; d) using a document containing another person’s signature without the consent of the authorized person; e) using such a document in dealings with a bank, financial institution, business, administrative authority, court or other person; f) obtaining a benefit, financing, credit, loan or other advantage on the basis of such a document; g) entering into an agreement or incurring an obligation using such a document; h) causing a bank, financial institution, business, administrative authority, court or other person to take action on the basis of such a document.
6.4. In the cases referred to in this Section, the Publisher is not a participant in the act performed by the User or a third party and does not make any statement concerning the content, authenticity or origin of the document. The mere use of the Application as a technical tool to create or modify a document does not constitute participation by the Publisher in the legal act to which the document relates.
6.5. The Publisher is not responsible for a decision made by a bank, financial institution, business, administrative authority, court or other third party concerning the recognition of a document as authentic, correct, effective or sufficient for the performance of a particular act, where such decision was made independently of the Publisher.
6.6. The Publisher is not a party to any agreement, loan, credit agreement, sale, guarantee, power of attorney or other legal relationship to which a document created or modified using the Application relates. The mere creation or modification of a document using the Application does not result in any obligation on the part of the Publisher arising from the contents of that document.
6.7. If damage results from the actions of a third party who, independently of the Publisher, obtained data or an image of a signature, used them without authorization, prepared or presented a false document, or caused another person to provide a benefit on the basis thereof, the use of the Application to perform technical operations does not mean that the actions of such person constitute actions of the Publisher.
6.8. The Publisher does not assume an obligation to prevent every possible misuse that may be committed by the User or a third party using a graphical tool operating locally on another person’s device.
7. Privacy and Data
7.1. The rules governing the processing of personal data are set out in the Privacy Policy available in the Application.
7.2. The Application processes documents and images of signatures, initials and stamps locally on the User’s device. The Publisher does not receive this data, does not store it in its systems and does not have access to it. This does not apply where the User independently transfers a document to another application or service — the rules governing such transfer are set out in Section 7.4.
7.3. The Publisher has no technical means of determining which documents the User opens, prepares, saves or to whom the User transfers them.
7.4. A document is transferred to another application or service solely at the User’s initiative. Further processing of the document then takes place in accordance with the rules established by the operator of the selected application or service.
8. License and Intellectual Property Rights
8.1. The Publisher owns the economic copyrights to the Application and the rights to the designations under which the Application is distributed.
8.2. Upon conclusion of the agreement, the Publisher grants the User a non-exclusive, non-transferable license to use the Application on devices at the User’s disposal, to the extent consistent with the intended purpose of the Application.
8.3. The User is not entitled to reproduce the Application for the purpose of distributing or reselling it, renting it out, lending it or granting further licenses, nor to decompile, reverse engineer or modify the Application, except to the extent permitted by mandatory provisions of law.
8.4. The User has no rights to the Application other than those expressly granted under the Terms.
8.5. The Publisher acquires no rights to documents, images or other content created or processed by the User using the Application. Rights to such content remain with the User or with the persons to whom such rights belong.
8.6. The Application contains components originating from third parties and made available under separate licenses. A list of such components together with the applicable license texts is available in the Application, in the “Licenses” section.
9. Free Version and Purchase of the Full Version
9.1. Downloading and installing the Application is free of charge.
9.2. In the free version, the User may save — that is, save or share — a number of documents specified in the Application. This limit applies to the number of documents, not the number of operations: the first saving of a given document uses one unit of the limit, whereas subsequent saving or sharing of the same document is free of charge.
The method used to determine whether a given document has previously been saved is specified by the Application; information concerning the remaining limit is displayed in the Application.
9.3. Once the limit has been used, the functions for saving and sharing a document require the purchase of the full version. The remaining functions of the Application, in particular opening documents, placing signatures, initials, stamps, text and dates in them, and viewing documents, remain available without purchase.
9.4. The purchase of the full version is a one-time payment, does not constitute a subscription and does not renew automatically.
9.5. The entitlement resulting from the purchase is assigned to the account used to make the purchase in the app store, and not to the device. After changing devices or reinstalling the Application, the entitlement may be restored using the same account, to the extent permitted by the operator of the app store. The Application provides a purchase restoration function.
9.6. The current price of the full version is displayed in the Application and in the app store before the purchase is made.
9.7. Work with documents takes place without an internet connection. An internet connection is required only when making a purchase and when restoring the purchase. If a connection is available, the Application automatically checks the status of the purchase in the app store when it starts; the absence of a connection does not restrict the use of the Application.
9.8. The entitlement resulting from the purchase expires if the amount paid is refunded or the purchase is cancelled by the operator of the app store, in particular as a result of withdrawal from the agreement, acceptance of a complaint or a chargeback. From that moment, the User may use the Application within the free scope set out in clauses 9.2 and 9.3, and the Application may cease to provide the functions of the full version.
10. Seller, Payments and Refunds
10.1. The Application is distributed through an app store. The purchase of the full version is made using the billing system of the operator of that store.
10.2. In accordance with the Google Play terms applicable on the effective date of these Terms, with respect to Users from the European Economic Area and the United Kingdom, the seller is the operator of that store — Google Commerce Limited, with its registered office in Ireland. In such case, the sales agreement is concluded between the User and that entity, and not between the User and the Publisher. The entity acting as the seller is indicated by the store operator; this information is available in the store before the purchase is made.
10.3. The Publisher does not accept payments directly from the User, does not process transaction settlements and does not issue refunds of amounts paid.
10.4. The User’s rights relating to the sales agreement, in particular the right of withdrawal and the rules governing refunds of amounts paid, arise from applicable law and the terms of the store operator and are exercised against that operator.
10.5. A Consumer has a statutory right to withdraw from a distance contract on the terms set out in applicable law. In the case of digital content supplied immediately after conclusion of the agreement, this right does not apply if the Consumer gave prior consent to performance before the expiry of the withdrawal period and was informed that they would lose the right of withdrawal, and the business provided the Consumer with confirmation of the conclusion of the agreement. Such consent is obtained by the store operator when the purchase is made; statements concerning withdrawal should also be addressed to that operator.
10.6. The above provisions do not limit the User’s rights against the Publisher arising from the Terms or from mandatory provisions of law.
11. Updates and Availability of the Application
11.1. The Publisher may provide updates to the Application, in particular updates that remove errors, improve security or ensure compatibility of the Application with new versions of the operating system.
11.2. The Publisher provides updates necessary to maintain the Application’s conformity with the agreement, including security updates and compatibility updates, for the period required by law and, in the absence of such a period, for the period during which the User may reasonably expect such updates to be provided, taking into account the nature and purpose of the Application. The Publisher informs the User about available updates through the app store.
11.3. Updates are made available through the app store. The method of installing them depends on the settings of the User’s device. If the User fails to install an available update necessary to maintain the Application’s conformity with the agreement, the Publisher shall not be liable for any lack of conformity resulting solely from the failure to install such update, provided that the User was informed about the update and the consequences of failing to install it, and the failure to install it was not caused by an inadequacy in the installation instructions provided.
11.4. To the extent permitted by law, the Publisher may discontinue development of the Application or withdraw it from distribution. Withdrawal of the Application from distribution does not automatically result in its removal from devices on which it was previously installed. Continued use of the Application may, however, be restricted as a result of changes to the operating system, device, system services, app store or other elements of the technical environment over which the Publisher has no control.
11.5. The Application requires the Android operating system version 7.0 or later. Information on compatibility with the User’s device is available in the app store before download.
12. Complaints and Out-of-Court Dispute Resolution
12.1. Complaints concerning the operation of the Application may be submitted by the User to the Publisher at office@jintsoftware.pl.
12.2. A complaint should contain a description of the issue, the model of the device and the version of the operating system and Application, as well as the address to which the response should be sent.
12.3. The Publisher shall examine the complaint and provide a response without undue delay, no later than within 14 days of receiving it. If the law applicable to the particular claim provides for a different time limit, the time limit prescribed by such law shall apply.
12.4. Complaints concerning purchase transactions, payments and refunds of amounts paid should be submitted by the User to the store operator, in accordance with Section 10.
12.5. A User who is a Consumer may use out-of-court methods of complaint handling and pursuing claims on the terms set out in applicable law, in particular by seeking assistance from a district or municipal consumer ombudsman or from a social organization whose statutory tasks include consumer protection, as well as by requesting that a dispute be resolved by an entity authorized to conduct proceedings for out-of-court consumer dispute resolution. The list of authorized entities is maintained by the President of the Office of Competition and Consumer Protection.
12.6. The rules governing the initiation and conduct of proceedings for out-of-court consumer dispute resolution, including requirements concerning the consent of the parties, are determined by law and by the rules of the relevant authorized entity.
13. Indemnification — Users Who Are Not Consumers
13.1. A User who is not a Consumer undertakes to indemnify the Publisher against justified claims of third parties and justified, directly incurred costs arising from that User’s unlawful or culpable conduct in connection with the use of the Application, in particular from the unlawful use of another person’s signature, initials, stamp, trademark or other legally protected content.
13.2. The obligation referred to in Section 13.1 does not cover claims arising from an act or omission of the Publisher or any scope of liability that cannot effectively be transferred to the User under mandatory provisions of law.
13.3. In the event of a third-party claim concerning a document, signature, initials, stamp, document content or the manner of using the Application, the User shall immediately inform the Publisher thereof and cooperate with the Publisher to the extent necessary to clarify the circumstances of the matter.
13.4. This Section does not apply to Users who are Consumers.
14. Limitation of Liability
14.1. The Publisher exercises due care to ensure that the Application operates properly. However, the Publisher does not guarantee that the Application will operate continuously and without errors on every device and in every version of the operating system.
14.2. In relations with a User who is not a Consumer, to the extent permitted by law:
a) statutory warranty for defects is excluded; b) the Publisher’s liability is limited to actual loss remaining in an adequate causal relationship with a culpable act or omission of the Publisher; c) the Publisher shall not be liable for lost profits, anticipated revenue, loss of contracts, or indirect or consequential damages.
14.3. The Publisher recommends that the User independently make backup copies of documents of significant importance. The Publisher does not store copies of the User’s documents and has no means of restoring them.
14.4. No provision of the Terms excludes or limits the Publisher’s liability to the extent that such exclusion or limitation is impermissible under mandatory provisions of law, in particular liability for damage caused intentionally and liability for personal injury.
15. Consumer Rights
15.1. Provisions of the Terms limiting the Publisher’s liability, concerning amendments to the Terms, jurisdiction, withdrawal from the agreement and conformity of the performance with the agreement shall apply to Consumers only to the extent permitted by mandatory provisions of law.
15.2. The Terms do not exclude or limit the rights of a Consumer arising under applicable law, in particular provisions concerning consumer rights and the conformity of digital content or a digital service with the agreement.
15.3. In the event of a conflict between a provision of the Terms and a mandatory provision of law protecting a Consumer, the mandatory provision of law shall prevail.
16. Term and Termination of the License
16.1. The license is granted for an indefinite period.
16.2. The User may terminate their use of the Application at any time by uninstalling it. Uninstalling the Application results in the deletion of data stored locally by the Application.
16.3. The Publisher may terminate the license with immediate effect in the event of a material breach of the Terms by the User, in particular a breach of the prohibitions set out in Section 5.4 or Section 8.
16.4. Termination of the license does not affect the validity of documents previously prepared by the User or the User’s rights to such documents.
17. Amendments to the Terms
17.1. The Publisher may amend the Terms for important reasons, in particular in the event of changes in the law, changes to the scope of the Application’s functions, changes to the pricing model or changes to the Publisher’s details.
17.2. A material amendment, in particular concerning the scope of liability, payment rules or the scope of the license, requires the User to accept the amended Terms again upon the next launch of the Application. An amendment of a purely editorial nature does not require renewed acceptance.
17.3. A User who does not accept the amended Terms may cease using the Application and uninstall it. Until the amended Terms are accepted, the User shall not use the Application.
17.4. An amendment to the Terms does not affect rights acquired by the User before the amendment enters into force, in particular entitlements arising from a previous purchase of the full version.
17.5. Each version of the Terms is identified by a version number and an effective date. The version of the Terms applicable to the User is made available in the version of the Application installed by the User.
18. App Store
18.1. The operator of the app store is not a party to the Terms.
18.2. Use of the app store is subject to separate terms established by its operator.
18.3. The operator of the app store is not responsible for the Application, its operation or content created by the User using the Application, subject to obligations arising from mandatory provisions of law and from the terms established by that operator.
19. Governing Law and Dispute Resolution
19.1. The Terms are governed by Polish law.
19.2. The choice of Polish law does not deprive a User who is a Consumer of the protection afforded to that Consumer by provisions that cannot be derogated from by agreement, in force in the country of that Consumer’s habitual residence. The Consumer is also entitled, as against the Publisher, to the rights and claims provided for by the law of that country, and the Publisher undertakes to comply with the mandatory provisions of that law.
19.3. Disputes with a User who is not a Consumer shall be resolved by the court having jurisdiction over the registered office of the Publisher.
19.4. Disputes with a User who is a Consumer shall be resolved by the court having jurisdiction in accordance with applicable law.
20. Final Provisions
20.1. If any provision of the Terms is found to be invalid or ineffective, the remaining provisions shall remain in force. The invalid or ineffective provision shall be replaced by the provision of law that most closely corresponds to the purpose of that provision.
20.2. Matters not regulated by the Terms shall be governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Copyright and Related Rights Act.
20.3. The Terms enter into force on the date specified in the heading.
20.4. The Terms were drawn up in the Polish language. The Polish version is the original version and shall prevail in the event of any discrepancy between language versions.
20.5. Clause 20.4 does not deprive a User who is a Consumer of the protection afforded by mandatory provisions of law. If a Consumer entered into the agreement on the basis of the Terms made available to that Consumer in another language and that version is more favourable to the Consumer, that version shall apply to the extent of the discrepancy.
